08/13/2016 តើអ្វីទៅជាបទបរិហារកេរ្តិ៍?     បរិហារកេរ្តិ៍ ជាមូលដ្ឋាន គឺជាការនិយាយ, ការសរសេរ, ឬគំនូរដែលធ្វើឲ្យប៉ះពាល់ដល់ កិត្តិយសអ្នកដទៃ។     ការបរិហារកេរ្តិ៍ក្លាយទៅជាបទល្មើសដែលអាចផ្តន្ទាទោសបាន លុះត្រាណាតែការបរិហារកេរ្តិ៍ នោះធ្វើជាសាធារណៈ។  មានន័យថា ការបរិហារកេរ្តិ៍ត្រូវបានធ្វើនៅទីកន្លែងសាធារណៈ ឬតាមមធ្យោ បាយណាមួយដែលពាក្យបរិហារកេរ្តិ៍នោះត្រូវបានឮឬឃើញសុះសាយជាសាធារណៈ ដូចជាតាម កាសែត វិទ្យុ ទូរទស្សន៍ ឬអ៊ិនទែណែតជាដើម។ ពាក្យបរិហារកេរ្តិ៍នៅទីកន្លែងឯកជនមិនត្រូវបានផ្តន្ទា ទោសទេ។ ហេតុដូច្នេះហើយបានជាច្បាប់ខ្មែរមានតែបទបរិហារកេរ្តិ៍ជាសាធារណៈ តែមិនបទ បរិហារកេរ្តិ៍ជាឯកជនទេ។ តាមក្រមព្រហ្មទណ្ឌខ្មែរ បទបរិហារកេរ្តិ៍គឺជាបទល្មើសមជ្ឈិម តែមិនមានទោសពន្ធនាគារទេ។  អ្នកដែលជាប់ទោសពីបទបរិហារកេរ្តិ៍នេះគ្រាន់តែត្រូវពិន័យជាប្រាក់ ពី មួយសែន រៀលទៅដប់លានរៀល និងត្រូវសងសំណងខូចខាតដល់ជនដែលត្រូវបរិហារកេរ្តិ៍ប៉ុណ្ណោះ។  មាត្រា ៣០៥ នៃក្រមព្រហ្មទណ្ឌ ចែងថា៖ គ្រប់ការអះអាងបំផ្លើស … Continue reading
